Massachusetts Simplifies Land Withdrawal Process

Recent legislative changes in Massachusetts have significantly simplified the process for landowners to withdraw their property from the land registration system. Previously, withdrawing land from Land Court was a complex process that required landowners to meet specific conditions, such as proving hardship or demonstrating that the land was a small portion of a larger parcel. However, with the signing of the Affordable Homes Act on August 6, 2024, and its effective date in February 2025, landowners can now voluntarily withdraw their registered land as of right. This means they no longer need to demonstrate specific reasons or meet strict criteria. The new process potentially reduces costs and delays, offering a more streamlined approach for those who prefer to work with the Registry of Deeds instead.
